Workplace attestation by working conditions in Kazakhstan

In accordance with paragraph 1 of Article 183 of the Labour Code of Kazakhstan, the owner of an enterprise must carry out attestation of production facilities by working conditions regularly, at least once every 5 years. Workplace attestation by working conditions is carried out together with representatives of the employees. This is governed by the Rules for mandatory periodic attestation of production facilities, approved by Order of the Ministry of Healthcare and Social Development of the Republic of Kazakhstan No. 1057 dated 28 December 2015.

Under sub-paragraph 18 of paragraph 2 of Article 1 of these Rules, production facilities are the sites or separate divisions of an enterprise engaged in manufacturing products, extracting, developing or processing minerals, construction work and other industrial activities. The inspection is carried out by specialised organisations.

The set of attestation activities

Workplace attestation by working conditions includes a range of activities, among them:

1. Analysis of the production facilities for compliance with the accepted standards of occupational safety and health;
2. Overall assessment of the facilities of the enterprise for compliance with occupational safety and health requirements.

The working conditions at a workplace are inspected in order to determine:

• the level of hazardous factors in the working environment and the complexity and severity of the work process;
• the level of injury safety and the availability of personal and collective protective equipment;
• whether the personal protective equipment matches the working conditions.

On completion of the inspection, the information obtained is entered in a special document — the attestation report for the production facility.

The report contains the following information:

1. General data on the full legal name, address, legal form and structure of the enterprise. It states the total number of employees and the number of employees in individual divisions, in particular those working at hazardous and harmful facilities. It also includes data on the reasons for the inspection, on the organisations engaged to carry out the attestation and on the members of the attestation board.

2. A description of the process. It covers the nature of the enterprise’s activities, the technologies used and a list of the hazardous and harmful factors, processes and technical devices.

3. A record of the instrumental, laboratory and ergonomic testing of the working conditions at the workplace.

4. A record of the assessment of the level of injury safety.

5. A record of the assessment of how well employees are provided with personal protective equipment.

Workplace attestation and timely occupational safety and health training help to reduce injuries and improve working conditions at production facilities.
